By accessing or using Jetrack ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

Jetrack provides website analytics services that enable users to track and analyze visitor data on their websites. Our service includes, but is not limited to:

• Real-time visitor tracking and analytics
• Traffic source analysis
• Campaign tracking and UTM parameter monitoring
• Geographic and device analytics
• Dashboard and reporting tools
• Public and shareable analytics dashboards

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To exploit, harm, or attempt to exploit or harm minors in any way
• To transmit any material that is defamatory, obscene, or offensive
• To impersonate or attempt to impersonate Jetrack, a Jetrack employee, or any other person
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service

We reserve the right to terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Jetrack and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Jetrack.

6. Payment Terms

For paid subscription plans, you agree to pay all fees associated with your selected plan. All fees are exclusive of applicable taxes, which you are responsible for paying.

Subscription fees are billed in advance on a monthly or annual basis and are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

We reserve the right to modify our pricing at any time. Any price changes will take effect following notice to you via the email address associated with your account.

7. Data Ownership

You retain all rights to the data collected through your use of the Service ("Your Data"). We claim no intellectual property rights over your data.

By using the Service, you grant us permission to collect and process Your Data solely for the purpose of providing the Service to you, in accordance with our Privacy Policy.

8. Limitation of Liability

In no event shall Jetrack, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for all claims arising from or related to these Terms or your use of the Service shall not exceed the amount you paid to us, if any, for the Service during the twelve (12) month period prior to the claim.

9. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Jetrack does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, that any defects or errors will be corrected, or that the Service is free of viruses or other harmful components.

10. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service will cease immediately.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
